The crisis is sharpening the legal defence strategies. The fact that many people stop paying off their mortgages has increased significantly the legal procedures as many financial entities are aiming the execution of the mortgage. However, another possibility consists in an ordinary execution procedure, not as fast or agile, to include all the assets of the debtor which will finally lead to seizure and a public auction sale of these assets. Two recent judgements confirmed that a creditor can execute the mortgage in accordance with the mortgage procedure and, at the same time, can seize all the other assets of the debtor or his guarantors in case there are.

Arrival of the first indemnifications for the delayed commencement of construction

A Court condemned an insurance company to pay back the payments made in advance by a British couple, including legal interests, with regard to a development in Estepona that suffered a delay in the commencement of the construction. Until now, it was only common to claim indemnifications for the delay in the delivery of the property.

Cheer at last for expats as M&S returns to Spain

For homesick British expatriates in Spain, the news will provide a welcome reminder of the old country: Marks & Spencer is coming back.

Moreover, it is heading for the resort of choice for the archetypal middle-aged, middle-class, sometimes very wealthy Brit abroad — Marbella, the playground of the Costa del Sol. More specifically 217.097 British are living on a permanent basis in Spain, and a large part of them in and around Marbella.

When the 14,000 sq ft franchised store opens its doors eight years after the retailer shut up shop in mainland Spain, the retailer is hoping that popular lines such as women’s lingerie and tins of shortbread will prove irresistible, and not only for the “exiles”. It also has its eye on attracting Spanish clients, for whom its stores were always a big draw.

The outlet will be franchised to York Limited, M&S’s long-term partner, and will complement its existing store in Gibraltar near by. It still has four stores in the Canary Islands.

Already the return of a British institution such as M&S has raised spirits among the expat population on the Costa del Sol, which has been hit hard by the fall in the value of the pound against the euro and the collapse of the Spanish property market.

The new store will sell a range of clothing, homewear and biscuits and cakes — but no fresh food, so M&S sandwiches are not on the menu.

More to the point, perhaps, reports in Spain suggest, with discernable optimism, that the Marbella store might mark the return of Marks & Spencer across mainland Spain. Begoña Zaragoza Tamarit, a marketing executive in Barcelona, said: “It would be great if they opened up again. I used to go to their stores all the time.”

However, a Marks & Spencer spokesman said: “We do always look for opportunities, but we want to see how this store goes before deciding on expanding.”

Clem Constantine, director of international at Marks & Spencer, said: “We’re delighted to be opening a new store in Marbella this autumn. We’ve had a successful franchise partnership with York Limited for over 40 years in Gibraltar and feel this is an excellent opportunity for us to offer our high-quality, good-value products to both the local and expat population in Marbella.”

The autumn Real Estate Fair of Madrid (SIMA) opens its doors today

The first edition of the autumn Real Estate Fair of Madrid (Salón Inmobiliario de Madrid - SIMA) is opening its doors today with a wide offer of homes for sale and for rent in around twenty provinces in Spain and in some developments abroad.
As a result of the great success of SIMA 2009, celebrated last May, the organisers decided to set up a second edition during this year.
More than 90 exhibitors will be present on the fair until next Sunday 25th of October. Visitors can count on significant price reductions that in some cases can reach up to 50% of the initial value of the house.
Between the participating developers you can find Acciona, Afirma, Realia, Reyal Urbis, Vallehermoso, San José, Habitat or Hercesa. Apart from the developers, financial institutions like Banco Santander, Caja Madrid, Caixa Catalunya and Ibercaja will be present at the fair.

Los barrios inaugurates the highest business centre of Andalusia

The business and technological zone Las Marismas de Palomares, in Los Barrios (Cádiz) counts since yesterday with the highest business centre of Andalusia.
This new centre is called the “Hercules Towers”, a project promoted by the company Valcruz. The building consists of two big cylindrical towers of 20 floors and 12.000 square metres each. The towers are linked by crystal bypasses on each floor. The construction has a building height of 126 metres. The two towers have been designed by the cordobian architect Rafael de la Hoz. The centre counts with an artificial lake that highlights even more this project.
The upper 20 metres of the building consist of bioclimatic screens that apart from protecting the building, are used to supply the entire project of solar energy. Each of the 20 floors of each building have a surface of 700 square metres. These floors can be divided into modules of 60 square metres depending on the need of each company, although the project focuses on major international investors that are able to acquire entire floors.
The construction of the Hercules Towers counted with an investment around 42 million euros. The objective of this project is to take advantage of the logistical and industrial potential of the Algeciras Bay and the excellent highway connections with Seville, Gibraltar, the Costa del Sol and the airport of Jerez de la Frontera.
